Notice is hereby given that on Monday, May 13, 2019, at 5:15 p.m., a public hearing will be held in the Superintendent's Conference Room (2nd Floor-South Building). In compliance with the provisions of Government Code section 3547, the Office of the º¬Ðß²ÝÉçÇø Superintendent of Schools, Psychologists and Social Workers Association, Service Employees International Union, Local 521 and Association of County Educators/California Teachers Association hereby submit their initial proposals for reopener negotiations for the 2019-2020 school year. The following identifies the specific articles for which each party is submitting an initial proposal:
Psychologists and Social Workers Association (PSWA)
PSWA
- Article 9, Article 11 Salary, and SCCOE benefit contribution
- Article 3, Extra Coverage Pay
- Article 7, Clinical Supervision Stipend
Service Employees International Union (SEIU)
SEIU
- Wage increase to allow the members to keep up with cost of living.
- Hire and retain Paraeducators through better benefits.
- Better collaboration for paraeducators and teachers for the benefit of the students.
- Allowing more flexibility for OSS unit when picking routes.
- Article 26 and Head Start – Allowing a reasonable workload to better serve the students and families.
- Article 8 – Clothing and shoe allowances.
SCCOE
Article 7.19-Bilingual/Biliterate Differentials
The SCCOE has an interest in addressing Bilingual/Biliterate Differentials.
Association of County Educators/California Teachers Association (ACE/CTA)
ACE:
- The Association of County Educators (ACE) is interested in opening Article 1, Recognition, in order to consider whether unrepresented groups should be added to our bargaining unit.
- ACE is interested in opening Article 2, Term of Agreement, for the purpose of aligning the new successor agreement bargaining dates.
- ACE is interested in opening Article 4, Association Rights, for the purpose of strengthening the discrimination language and creating a process by which claims of discrimination are investigated by the employer.
- ACE is interested in opening Article 5, Member Rights, in order to fold in multiple concerns raised by the membership around classroom safety, the MOU regarding covering a class that has no substitute, formalizing the placement committee and process the employer engages for placement of students, the triggering of training/support for difficult classroom situations, equalizing the Children's Services programs regarding staffing/support/materials and preparation time, as well as other solutions to safety issues raised by the membership.
- ACE is interested in opening Article 6, Professional Dues of Fees, in order to align it with the MOU.
- ACE is interested in opening Article 8, Evaluation, in order to clarify that Evaluation is not Disciplinary in nature, nor should Discipline be Evaluative in nature.
- ACE is interested in opening Article 9, Personnel Files, in order to add language regarding the investigative period, length of paid leave, and responsibility of the employer to complete a thorough and timely investigation.
- ACE is interested in opening Article 10, Discipline, for the purpose of identifying the process, timeline and outcome of investigations. Additionally, we are interested in modifying the process of appealing a disciplinary decision.
- ACE is interested in opening Article 11, Complaint Procedure, to strengthen the rights of teachers to, when legally possible, receive a true copy of a complaint and know the identity of those who file complaints (unless protected by law).
- ACE is interested in opening Article 12, Transfer, Reassignment, Modification, Position Change, for the purpose of ensuring a transparent and legitimate process for considering transfer requests, as well as clarifying the employer's rights to deny requests for transfer.
- ACE is interested in opening Article 13, Hours and Work Year, for the purpose of bringing into the contract all the disparate MOU's for programs not specifically identified in this Article. Additionally, we wish to clarify the process by which DIS staff participate in after school meetings, modify the definitions attached to the non-student contact days, as well as expand the options for Professional Development. If necessary, ACE also wishes to align the work years with separate programs, for STRS purposes.
- ACE is interested in opening Article 11
- ACE is interested in opening Article 12, Leaves, for the purpose of adding specificity to use of Personal Leave.
- ACE is interested in opening Article 14, Safety, for multiple goals—including, but not limited to, the processes and procedures the employer follows in order to insure staff and student safety; training and support needed to insure classroom safety; processes regarding placement; identification of a minimum level of staff to student ratio and determining how to maintain that; and establishing emergency procedures and plans when classes are "short staffed."
- ACE is interested in opening Article 17, Retirement/Reduced Workload, in order to encourage retirees to substitute, particularly in hard to fill assignments.
- ACE is interested in opening Article 19, Salaries, in several ways: what qualifies as "years of service credit" for initial placement; base pay; overtime versus per diem; stipends—multiple degrees, TIC, Mileage, medical procedures, writing IEPs for absent staff or uncovered caseloads, cell phones, hiring and maintenance and DIS pay—; as well as, compensatory time, and tuition reimbursement.
- ACE is interested in opening Article 20, Benefits, for the purpose of increasing the employer's contribution to benefits, as well as increasing the dental/orthodontia coverage.
- ACE is interested in creating an Article, Class Size and Caseload, for the purpose of establishing appropriate class sizes and workable caseloads.
- ACE is interested in aligning all other areas of the contract with both the modifications made in any one area that is repeated or reflected elsewhere, as well as updating all dates and timelines to reflect the successor agreement.
- ACE is interested in reviewing all MOUs to determine which are no longer necessary, which should be folded into the contract articles, and which need renewing but should remain MOUs.
SCCOE
Article 2 – Term of Agreement
The º¬Ðß²ÝÉçÇø Office of Education has an interest in discussing the term of the parties' successor collective bargaining agreement.
Article 13 – Hours and Work Year
The º¬Ðß²ÝÉçÇø Office of Education has interest in discussing a number of issues falling under Article 13 including, but not limited to:
- work year for specific programs;
- work hours and instructional minutes for ACE represented positions;
- implementing language related to daily instruction guided by lesson plans.
Article 19 – Salaries
The º¬Ðß²ÝÉçÇø Office of Education has an interest in discussing salaries within the context of the SCCOE being fiscally responsible.
Article 20 – Benefits
The º¬Ðß²ÝÉçÇø Office of Education has an interest in discussing medical benefits within the context of the SCCOE being fiscally responsible.
The º¬Ðß²ÝÉçÇø Office of Education reserves the right to open additional articles during the course of the parties' negotiations.
A public hearing will be held on the above specified articles of the parties' collective bargaining agreement and after such public hearing, the parties will be able to start negotiations on those topics.
Initial proposals of the Office of º¬Ðß²ÝÉçÇø Superintendent of Schools, Psychologists and Social Workers Association, Service Employees International Union, Local 521 and Association of County Educators/California Teachers Association will be available for public review in the º¬Ðß²ÝÉçÇø Superintendent's Conference Room (located in the Superintendent's Office/2nd Floor-North Building) at 1290 Ridder Park Drive, San Jose, CA 95131.
º¬Ðß²ÝÉçÇø Office of Education encourages participation from parents, teachers, community members and bargaining unit leaders.
